An income or capital beneficiary(s) of a trust may feel that a trust has been mismanaged and/or their interests have not been properly safeguarded by a trustee(s). A beneficiary may therefore decide to launch a legal action against the trustee(s) to recover investment losses, challenge trustee compensation, or seek the advice and direction of the court regarding the proper investment “mix” for the trust or even vary or wind-up the trust.
